The agreement between you and Dunne, Corp. when you use this website, an account here, or our software.
Last updated:
These terms are an agreement between you and Dunne, Corp. (“DunneCorp”, “we”, “us”). They cover this website, the account and customer portal you can create here, and our commercial software, DunneNote and DunneWrite. By creating an account, buying a licence or using the software, you agree to them. If you are accepting on behalf of a company, you confirm you can bind it to these terms.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy, you also accept Paddle's buyer terms, and Paddle's privacy notice applies to the payment details you give it.
Prices are shown in US dollars on our pricing page; Paddle shows your local price where one is set and adds any sales tax or VAT at checkout. Refunds follow our refund policy.
DunneNote and DunneWrite are licensed, not sold. When you buy, we give you a personal, non-exclusive, non-transferable licence to install and use the product, for one person, on all the computers that person uses. A company may buy a licence for each person who uses the product. Your licence comes as a licence key, which you paste into the app; your current key is always in your account.
Without a current licence, for example after a subscription ends, or in a version released after your 12 months of updates, you never lose access to your own work:
You may not:
Notebooks, stories and everything else you create with our software belong to you. The software stores them on your own computer, and we claim no rights in them. DunneNote notebooks are in an open, documented format, so you can read them without us.
Some DunneWrite features send text to an AI provider that you choose and connect with your own account and key. That exchange is between you and that provider, under its terms; we are not a party to it and don't receive what is sent.
DunneFlow and the DunneNote format library (dunnenote-format) are open source. Their own licences, published with their source code, govern them instead of section 2. Our commercial products may include open-source components, each under its own licence.
You can close your account at any time by asking us. We may suspend or close an account that breaks these terms; if we do, we'll tell you why, unless the law stops us. Closing an account doesn't end a licence you have already paid for.
We provide support through tickets in the customer portal and by email, for as long as your licence entitles you to updates: while you subscribe, and for 12 months after you buy or your subscription becomes yours. We aim to reply within one business day. Updates may change or remove features; we won't remove your ability to open your existing content.
Products and features marked pre-release, preview, beta or draft are offered as they are, may change and may contain more bugs than a finished release. Keep backups of anything important.
We build our software carefully and want it to work for you. If it doesn't, use the refund policy or tell us so we can fix it. Apart from that, and to the extent the law allows, the software and website are provided “as is”, without any other warranty, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the software will be free of errors or that it will never lose data, so keep backups.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data, arising from these terms or your use of the website or software. Our total liability for any claim is limited to the amount you paid us for the product concerned in the 12 months before the claim.
Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer under the law where you live.
We may update these terms. The date at the top of this page changes when we do, and if a change materially affects people who have already bought, we'll tell them by email before it takes effect. A change never takes away a licence you have already paid for.
Dunne, Corp. is a Delaware corporation. These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. If you buy as a consumer, you also keep the protection of the mandatory laws of the place where you live, and you may bring a claim in your local courts.
